Welcome to Hibernate! Thank you for choosing Hibernate by The Sleeping Bears, Inc. (“The Sleeping Bears”). We're excited to offer you our exclusive relaxation and meditation services via our mobile device application (“App”). Collectively, these components are termed our “Services”. While we strive for excellence, please understand we're in our growth phase. Your patience and understanding are invaluable. Please read the following Terms of Service (the “Terms”) carefully as they govern your access to and use of our Services.

  1. Acceptance of the Terms
    By accessing or using our Services, you confirm that you have read, understood, and agreed to be bound by these Terms. If you disagree with any part of these Terms, then you may not access or use the Services.

  2. Privacy Policy
    Protecting your privacy is crucial to us. If you want to learn more about our it, you can check out our Privacy Policy. By using our Services, you consent to the collection, use, and sharing of your information as outlined in our Privacy Policy.

  3. Updates to the Terms
    We may modify or replace these Terms as we refine Hibernate. Should there be any changes, we'll update you within the App. It's advisable to revisit these Terms periodically. If you continue to use our Services post-modification, this implies your acceptance of the updated Terms. If you disagree with the revised Terms, please cease using our Services.

  4. Dispute Resolution
    Except as expressly provided otherwise, any disputes arising out of or relating to these Terms or use of our Services will be resolved through individual arbitration.   5. User Eligibility

    • Age Restrictions: Hibernate welcomes users of all backgrounds! But, you need to be at least 13 years old to access our Services. For transactions (refer to “Purchases” section), users must be 18 years or older with the legal capacity to enter contracts.
    • Account Management: Certain features may necessitate creating an account. Registration can be direct or via third-party platforms like Facebook. It's vital to provide accurate, up-to-date details. Maintain the confidentiality of your password and notify us of any security breaches. You bear responsibility for all activities under your account.
  6. Purchases and Payments
    6.1 Subscriptions: Some of Hibernate’s features or content may require a paid subscription. Subscriptions may come in varying lengths and prices, as described within the App.
    6.2 Payment: All payments are processed through third-party payment processors. By making a purchase, you agree to pay the specified price, and you authorize us, through our third-party payment processors, to charge the payment method you provide.
    6.3 Renewals: Unless otherwise noted, subscriptions will automatically renew for the same duration at the then-current subscription rate. You can manage or cancel your subscriptions at any time through the App's settings or the platform from which you downloaded the App.
    6.4 Refunds: All sales are considered final.
    6.5 Price Changes: The Sleeping Bears, Inc. reserves the right to modify subscription prices. We will provide notice of any price changes within the App or via email. If you disagree with the price change, you have the right to reject the change by canceling your subscription before the price change goes into effect.
    6.6 Free Trials: From time to time, we may offer free trials for our subscriptions. Unless we notify you otherwise, free trials will be converted to a paid subscription at the end of the trial period. It is your responsibility to cancel if you do not wish to be charged.

  7. Usage Guidelines
    Hibernate presents a handpicked assortment of relaxation and meditation tools. Some functionalities may fall under a premium category, promising a rich experience. However, note that Hibernate doesn't substitute professional medical counsel. Ensure you don't use Hibernate while driving or when engaged in activities demanding undivided focus. Your safety remains a personal responsibility.
